Terms of Service

1. Agreement

By using the Navya Wellness platform ("Service"), operated by Navya AI Inc. ("Navya," "we," "us"), you agree to these Terms of Service. If you do not agree, do not use the Service. These Terms are governed by the laws of Ontario, Canada, and applicable federal laws of Canada.

2. Description of Service

Navya Wellness is an AI-powered voice-first caregiver platform that provides:

  • Automated wellness check-in phone calls to designated care recipients
  • Medication reminder and adherence tracking
  • Mood and health monitoring through voice analysis
  • Real-time alerts to family caregivers
  • Health trend reports
  • Emergency detection and escalation

3. Important Disclaimers

Navya is NOT a medical device, healthcare provider, or emergency service. Navya does NOT diagnose medical conditions, provide medical advice, or replace professional medical care. Always consult a qualified healthcare provider for medical concerns. In a medical emergency, call 911 directly.

  • Navya's wellness assessments are AI-generated indicators, not clinical diagnoses
  • Voice biomarker data is for informational purposes only
  • Emergency detection is best-effort and should not be relied upon as a sole emergency response system
  • We do not guarantee uninterrupted service — phone networks, AI systems, and internet services may experience outages

4. Accounts & Consent

  • You must be at least 18 years old and a resident of Canada to create an account
  • You are responsible for obtaining consent from the care recipient (or their legal guardian/Power of Attorney) before adding them to the Service
  • You are responsible for the accuracy of health information, medications, and emergency contacts you provide
  • You must not use the Service for any unlawful purpose

5. Pricing & Payment

  • All prices are in Canadian Dollars (CAD) unless otherwise stated
  • Trial period: $1 CAD for 7 days. After the trial, your selected plan begins automatically
  • Subscriptions are billed monthly or annually as selected
  • Prices may change with 30 days' notice
  • Applicable taxes (GST/HST/PST) are added at checkout
  • Payments are processed by Stripe Canada

6. Cancellation & Refunds

  • You may cancel your subscription at any time from your dashboard or by contacting support
  • Ontario residents: You have a 10-day cooling-off period for internet agreements under the Consumer Protection Act, 2002
  • 30-day money-back guarantee: If not satisfied within the first 30 days after your trial, we will refund your subscription payment in full
  • After 30 days, cancellation takes effect at the end of the current billing period — no partial refunds

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. Key points:

  • All health data is stored exclusively in Canada (AWS ca-central-1)
  • We comply with PIPEDA, PHIPA, and applicable provincial health privacy laws
  • We do not sell your personal information
  • AI providers process data under DPAs and do not use your data for model training

8. Intellectual Property

The Service, including its AI models, voice technology, user interface, and content, is owned by Navya AI Inc. and protected by Canadian and international intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Navya AI Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages related to:

  • Failure to detect a medical emergency
  • Inaccurate wellness assessments or mood scores
  • Service outages or call failures
  • Actions taken or not taken based on information provided by the Service

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Governing Law & Disputes

These Terms are governed by the laws of Ontario, Canada, and applicable federal laws of Canada. Any disputes shall be resolved in the courts of Ontario, Canada. Nothing in these Terms limits your rights under the Consumer Protection Act, 2002 (Ontario) or other applicable consumer protection legislation.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use after changes constitutes acceptance.
